These terms and conditions of sale are entered into between, on the one hand, WERTRONIC, a company with a share capital of €7,500.00 (fixed), whose registered office is located at 3 rue Saint Joseph, 75002 Paris, registered with the Paris Trade and Companies Register under number 483 515 904, hereinafter referred to as "WERTRONIC" and operating the website https://wertronic.com, and, on the other hand, any individual or legal entity wishing to make a purchase via the website https://wertronic.com, hereinafter referred to as "the buyer".
Article 1. Purpose
These terms and conditions of sale aim to define the contractual relationship between Wertronic and the buyer and the conditions applicable to any purchase made through the website https://wertronic.com. Purchasing a product through this website implies the buyer's unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, firstly, that the purchase of products on the website https://wertronic.com is unrelated to their professional activity and is limited to strictly personal use, and secondly, that they have full legal capacity to enter into this agreement under these terms and conditions of sale. WERTRONIC reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.
Article 2. Products
The products offered are those listed on the Wertronic website https://wertronic.com, subject to availability. Wertronic reserves the right to modify its product range at any time. Each product is presented on the website with a description outlining its main technical characteristics. The photographs are as accurate as possible but are not contractually binding on the Seller. The sale of products presented on the website https://wertronic.com is intended for all buyers residing in countries that fully authorize the import of these products into their territory.
Article 3. Prices
The prices listed on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Wertronic reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, depending on the destination of the order and the weight of the package.
Article 4. Ordering and Payment Methods
Before placing any order, the buyer must create an account on the website https://wertronic.com. The account creation section is accessible directly from the sidebar menu. Each time the buyer visits the site, if they wish to place an order or view their account (order status, profile, etc.), they must log in using their credentials. Wertronic offers the buyer the option to order and pay for their products in several steps, with three payment options:
- Payment by check:
The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. The buyer then selects their preferred payment method: "Payment by check." Finally, the last step asks the customer to verify all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation email. To finalize payment and initiate order processing, the buyer must print this order confirmation and send it, along with a check made payable to Wertronic, to the following address: 3 rue Saint Joseph, 75002 Paris, France. Cash payments will not be accepted. Only checks drawn on a French bank will be accepted. Upon receipt of the check, the order will be processed, and the buyer will be notified by email. Wertronic will ship the products no sooner than 3 business days after the check corresponding to the order has cleared, subject to availability.
- Payment by bank transfer:
The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by bank transfer." Finally, the last step allows them to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation email. To finalize payment and initiate order processing, the buyer must contact their bank to transfer the corresponding amount to Wertronic's bank account, the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be notified by email. Wertronic will ship the products no sooner than 3 business days after receiving the corresponding transfer, subject to availability.
- Secure payment via PayPal or credit card (through the PayPal system):
The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment via PayPal." The following step allows them to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the secure PayPal interface to safely enter their PayPal account or credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment via PayPal or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the card payment, and the sums paid will then be credited back or refunded. The cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or 120 days if their contract with the bank stipulates this. The debited amounts are refunded by the bank within a maximum of one month after receipt of the cardholder's written dispute. The cardholder will not be charged any fees for the refund.
Confirming an order implies acceptance of these terms and conditions of sale, acknowledgment of having read and understood them fully, and waiver of any conflicting terms and conditions of purchase. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, Wertronic will send them an email confirming their order.
If the buyer wishes to contact Wertronic, they can do so either by mail at the following address: 3 rue Saint Joseph, 75002 Paris, France; or by email using the contact form on the wertronic.com website.
Article 5. Retention of Title
Wertronic retains full ownership of the products sold until full payment of the price, including principal, fees, and taxes, has been received.
Article 6. Right of Withdrawal
Pursuant to Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.
Article 7. Warranty
The warranty period offered on our products is specified in each listing. It covers repair costs, parts and labor; any shipping costs to and from the customer remain the responsibility of the customer.
Article 8. Delivery
Deliveries are made to the address indicated by the buyer when placing their order on the website, which must be within the agreed geographical area. In the event that delivery is impossible (the package is returned to the sender) due to an error in the address provided by the buyer, Wertronic will resend the order to the new delivery address provided by the buyer, after the buyer has paid any additional delivery charges, which will remain their responsibility.
Deliveries are made to the buyer's home or to a pickup point via UPS, Mondial Relay, or another method selected by the buyer during checkout. A tracking number will be provided to you upon ordering.
Delivery times are provided for informational purposes only; if they exceed thirty days from the date of the order, the sales contract may be canceled and the buyer refunded.
The buyer assumes all risks associated with shipping from the moment the items leave Wertronic's premises. The buyer is required to check the condition of the packaging and its contents upon delivery, in the presence of the delivery person.
In case of damage during transport, any complaint must be made to the carrier within three days of delivery.
Article 9. Warranty
All products supplied by Wertronic are covered by the legal warranty stipulated in Articles 1641 et seq. of the French Civil Code. In the event of a product's non-conformity, it may be returned to Wertronic, who will accept the return, exchange the product, or issue a refund. All claims, requests for exchange, or refunds must be made by mail to the following address: Wertronic, within thirty days of delivery.
Article 10. Liability
In the distance selling process, Wertronic is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional problems.
Article 11. Intellectual Property
All elements of the website https://wertronic.com are and remain the exclusive intellectual property of Wertronic. No one is authorized to reproduce, exploit, or use in any way whatsoever, even partially, any elements of the website, whether in the form of photos, logos, visuals, or text.
Article 12. Personal Data
Wertronic is committed to preserving the confidentiality of information provided by the buyer, which may be transmitted for the use of certain services. All information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete their personal information. They may request this at any time by mail to the following address: Wertronic, 3 rue Saint Joseph, 75002 Paris, France.
Article 13. Dispute Resolution
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
Seeking an amicable solution does not interrupt the time limits for taking action under warranty. Failing that, the competent courts will be those within the jurisdiction of Paris.
